Sinead Murphy

Sinead is a commercial litigation solicitor with experience working on property disputes, financial services litigation, professional negligence and contractual claims and contentious regulatory work.  Sinead delivers commercially practical advice to clients on available causes of action, merits of claims, liability, costs and case strategy and is particularly focussed on achieving early resolution of disputes without recourse to litigation. Prior to joining HOS Partners LLP, Sinead was a senior associate in the litigation and dispute resolution department for Byrne Wallace where she worked for 10 years.

A brief selection of Sinead’s experience includes:

  • Acts for vendors and purchasers in disputes concerning the sale of properties to include obtaining vacant possession, service of completion notices and forfeiture of deposits.
  • Represents landlords and tenants in relation to rent claims and disputes involving break options, forfeiture, tenant’s statutory entitlements and unreasonably withholding landlord consent.
  • Acts for parties in connection with rights of way and boundary disputes and encroachment and adverse possession claims.
  • Acted for receivers in relation to claims brought by parties challenging the validity of the receiver appointments, bank security, demand and enforcement procedures and adherence to Central Bank Codes of Conduct.
  • Advises a retailer on commercial contract matters both regulatory and contentious matters with a particular focus on general consumer and online sales law.
  • Represented the Financial Services and Pensions Ombudsman in High Court appeals brought by consumers concerning adjudications into consumer complaints involving allegations of mis-selling and mismanagement of financial investment products, banking services, insurance products and related services.
  • Represented a state body in arbitration proceedings in relation to a claim for compensation concerning a CPO of lands by a Local Authority.
  • The lead solicitor in a Commercial Court action on behalf of a purchaser of a commercial development site in a successful claim against a Local Authority arising from a breach of contract and misrepresentation for a failure to disclose a material fact in a contract in relation to a distributer road servicing the development site.
  • Represented various banks in relation to High Court actions involving solicitor’s negligence and breach of contract claims arising from a failure to perfect security.
